Service Description
Our transportation services provide
delivery of goods to customers in Europe. Our transportation services are
subject to availability and we reserve the right to refuse service to anyone at
any time.
Order Acceptance and Delivery
Orders placed with us are subject to our
acceptance. We will make every effort to deliver your order within the time
frame specified. However, we cannot guarantee delivery times and are not
responsible for any delays caused by events outside of our control.
Customer Responsibility
It is the customer's responsibility to
provide accurate and complete information when placing an order, including the
delivery address and contact details. We will not be held responsible for any
errors or delays caused by inaccurate information provided by the customer.
Payment
Payment for transportation services must be
made at the time of ordering. We accept all major credit cards and debit cards.
All transactions are processed securely through our payment gateway.
Cancellation and Refund Policy
Customers may cancel an order at any time
before the transportation service has been initiated. If you cancel your order
after the transportation service has been initiated, we reserve the right to
charge a cancellation fee. Refunds will be processed within 10 business days of
the cancellation request.
Limitation of Liability
Our liability for any loss or damage
arising from the use of our transportation services is limited to the cost of
the transportation service provided. We will not be held liable for any
indirect or consequential loss or damage arising from the use of our services.
Governing Law and Jurisdiction
These terms and conditions are governed by
and construed in accordance with the laws of Lithuania law and any disputes
arising from these terms and conditions will be subject to the exclusive
jurisdiction of the courts of Lithuania.
Changes to Terms and Conditions
We reserve the right to update or modify
these terms and conditions at any time without prior notice. By continuing to
use our services, you agree to be bound by the updated or modified terms and
conditions.
Additional Clause Regarding CMR Convention
and Responsibilities
CMR Convention
Our transportation services are subject to
the provisions of the CMR Convention. The CMR Convention sets out the rights
and obligations of the parties involved in international road transportation,
including the carrier, the sender, and the recipient of the goods.
Carrier's Responsibilities
As the carrier, we are responsible for the
safe transportation of your goods from the place of pickup to the place of
delivery. We will take all necessary measures to ensure that your goods are
transported in accordance with the CMR Convention and our standard operating
procedures.
Sender's Responsibilities
As the sender, it is your responsibility to
ensure that your goods are properly packed and labeled for transportation. You
must also provide accurate and complete information about the goods being
transported, including their weight, dimensions, and value.
Recipient's Responsibilities
As the recipient, it is your responsibility
to inspect the goods upon delivery and report any damages or shortages to us
within 24 hours of receipt of the goods. Failure to report damages or shortages
within this time frame may result in the rejection of any claims for
compensation.
Liability for Loss or Damage
In the event of loss or damage to the goods
during transportation, we will be liable for compensation in accordance with
the CMR Convention, subject to the limitations and exclusions set out in the Convention.
The amount of compensation will be calculated based on the weight of the goods
and the current rate of compensation under the Convention.
Exclusions of Liability
We will not be liable for any loss or
damage arising from events outside of our control, including but not limited to
acts of God, wars, strikes, or natural disasters. We will also not be liable
for any indirect or consequential loss or damage, including but not limited to
loss of profits, business interruption, or loss of data.
Insurance
We recommend that you take out insurance
for your goods prior to transportation. Our liability for loss or damage to
your goods is limited to the compensation provided for under the CMR Convention
and may not be sufficient to cover the full value of your goods.
Governing Law and Jurisdiction
Any disputes arising from these terms and
conditions will be subject to the exclusive jurisdiction of the courts of
